Terms and Conditions

Rock Steady Adventure Terms and Conditions of Booking

Please read carefully the booking conditions and information contained on our booking form as these form the basis of your contract with Rock Steady Adventure and set out the respective rights and obligations of both parties.

In the following booking conditions ‘you’ means the party leader/individual requesting the booking and ‘we’ and ‘us’ means Rock Steady Adventure.



To Confirm the Booking

No booking will be final and no contract will be entered into until the deposit(s) for each person together with a completed booking form duly signed by you has been received and acknowledged in writing by Rock Steady Adventure. By signing the booking form you confirm you are authorised to make the booking on the basis of these booking conditions by all members of your party (or the parent or legal guardian where any member is less than 18 years old) and that all party members agree to be bound by these booking conditions.

On receipt of the fully completed booking form and deposit, we will issue a confirmation of booking which sets out arrangements.



Price

Once you have booked, the agreed price of your booking is fully guaranteed by Rock Steady Adventure and will not be subjected to any surcharge provided you meet the payment schedule. N.B. This does not apply to invoice errors or government action.



Schedule of Payment

We require a deposit of 50% of total fee per person, together with the completed booking form in order to confirm the booking. The final balance is due 1 month prior to your booked date (or at the time of booking, whichever is later).

Note: the date your final balance is due is shown on the confirmation of booking and no reminder will be sent. If any payment due is not received in full and on time we reserve the right to treat the booking as cancelled by you.



Cancellations by the Client

You or any member of your party may cancel your booking at any time. Written notification from you (the party leader) must be received at our office. In all cases of cancellation the deposit(s) will be forfeited.

The date of cancellation is the date of receipt of written advice to Rock Steady Adventure.

N.B: if the reason for cancellation is due to proven injury or illness sustained by you we may (but are not obliged to) offer an alternative date to be taken up within 3 months of the original booking date.


Cancellation charges are payable as follows.

• more than 1 month of your booked date – Deposit only.

• within 1 month of your booked date – 100% of total fee.

Alterations by the Client

Rock Steady Adventure will, wherever possible, try to accommodate any alterations you may request after the contract is formed.

Alteration requests must be made in writing to us by your party leader.

Alterations requested more than two months in advance of your booked date (such as change of activity, course, date) if acceptable, are subject to an administration charge of £10 per booking.

Major alterations within two months of a booked date may be treated as a cancellation and require re-booking.

Any person removed from the booking form will be treated as a cancellation and cancellation terms, as above, will be applied. However any new person replacing him/her will be treated as part of the original booking provided they complete our Personal Information form prior to the activity.



Alterations by Rock Steady Adventure

The arrangements detailed in the booking document are given in good faith, but we reserve the right to provide comparable alternative arrangements if optional or other considerations so dictate.

No employee or representative of Rock Steady Adventure has the authority to verbally vary these terms and conditions (or the information within other literature belonging to Rock Steady Adventure) or to enter into verbal agreements with clients of Rock Steady Adventure. No variation in these conditions or otherwise in the terms upon which a booking is made, and no promise to refund money previously paid to Rock Steady Adventure, shall be valid unless in writing and signed by the central office.

If we make a major change to your booking, we will inform you as soon as reasonably possible. You will have the choice of either accepting the change of arrangements or cancelling your booking and receiving a full refund of all monies paid.



Force Majeure

Rock Steady Adventure reserves the right to cancel/curtail your booking due to circumstances amounting to Force Majeure – these include, but are not limited to, weather conditions, fire, war, riot, terrorism, government action, strike action, and all similar events outside our control which prevent or affect our contractual obligation.

Where such circumstances occur the company will not be liable to pay you refunds or compensation.

Restrictions

Rock Steady Adventure and its entire staff are responsible for the safe conduct of your activity and may vary the itinerary to that end. They alone shall decide whether or not the activities are available, or conditions are safe. It is not permitted for any Rock Steady Adventure’ equipment to be used for/or to participate in any third party activity, without the prior written approval of Rock Steady Central Staff.

All activities are offered subject to availability.

Rock Steady Adventure cannot be held responsible for loss of use of equipment or venues due to adverse weather conditions.



Company Liability and Acknowledgment of Risk

All clients must read and accept the acknowledgment of risk statement below, as it may affect their safety, and the safety of others attending the activity programme.


Acknowledgement of Risk

Adventure activities, such as rock climbing, kayaking, mountain biking etc are hazardous pursuits.  Rock Steady Adventure has taken all reasonable steps to manage the level of real risk to a level that we believe is acceptable.  The level of real risk is generally confined to a similar level that a normal individual would experience when involved in normal active recreation and whilst the chances of serious injury are remote, the chances of minor injury (bruises, bumps and minor fractures) have to be seen as possible outcomes.

We are not able to remove all risk from the activities without destroying the activity, or the reason for doing it. This is NOT a disclaimer, and does not release Rock Steady Adventure from its obligations towards you.  It is to make sure that you know what you are letting yourself in for!  If you have any questions, call us on 08456 12 36 36. Only if you are comfortable with the level of risk to which you could be exposed should you make the booking.

Rock Steady Adventure accepts responsibility should any services which we are contractually obliged to provide prove deficient or not of reasonable standard.

Save that as detailed below, no liability is accepted for death, injury or illness.

Rock Steady Adventure does not accept liability or responsibility for personal injury to, or the death of any participants howsoever caused, unless by the proven negligence of us. In addition, the company is NOT liable for death, injury or illness caused by an activity outside of Rock Steady Adventure’ activities.

Rock Steady Adventure cannot accept liability for causes of dissatisfaction which are not notified to us, in writing, within 7 days of completion of the activity.

Party Leaders Responsibility

The party leader (i.e. person making the booking) is responsible for seeing that all members of the party are physically fit to take part in the course or activity.  All adults accompanying a party are held responsible for the good behaviour of children in that party and will adequately supervise them.

Where damage is caused to any of Rock Steady Adventure’ equipment e.g. canoes, safety gear etc, by a party member as a result of wilful damage or whilst under the influence of drink or drugs, or as a result of a party member not obeying our staff’s instructions, then that person, or parent or legal guardian of that person, will be responsible for the full amount of the repair or replacement of the goods.

The party leader is responsible for providing Rock Steady Adventure with any known medical condition that may potentially affect the personal safety of any party member, and for notifying us of any special needs of any party member on our Medical Consent form.

Parents/guardians are responsible for picking up students promptly at the time stated as the end of the activity. We cannot be held responsible for child care after the activity has ended.



Termination of Booking

We reserve the right in our absolute discretion to terminate without further notice the booking arrangements of any client who refuses to comply with the instructions or orders of Rock Steady Adventure’ staff or other responsible person, and/or whose behaviour in our opinion is likely to cause distress, damage, danger or annoyance to other clients, staff, and any third party, or to property.

Upon such termination our responsibility for your booking ceases and we shall not be liable for any refund of monies nor for any extra costs incurred by you. Complaints

Our aim is to give you an enjoyable and trouble free time. If you do have a problem or complaint it is important, and in your own interests, to tell the relevant member of Rock Steady Adventure’ staff immediately, so that steps can be taken to resolve the matter directly. If your complaint cannot be resolved immediately, please notify us in writing within 7 days.

We strongly recommend that you communicate any problem to our staff without delay. If you do not, we will have been deprived of the opportunity to investigate and rectify your complaint whilst you are with us and this may affect your rights of contract. Disputes arising out of, or in connection with, a contract which cannot be amicably settled may be referred to arbitration if you so wish, under a special scheme which is administered independently by the Chartered Institute of Arbitrators.



Insurance

We strongly recommend that you are insured for your activity with us, and that groups take out travel insurance to protect against financial loss in the event of cancellation.



Brochures/publicity/leaflets

Rock Steady Adventure’s brochure/publicity/leaflets are prepared some months in advance. Every effort is made to ensure the accuracy of the facts contained therein. Circumstances may arise however where certain particulars have to be modified. In these circumstances we will make every effort to provide suitable alternatives, but we will not be held liable for changes caused by outside influences.

Our members of staff are often asked for information not contained in the brochure/leaflets. While every effort is made to ensure all information given is correct Rock Steady Adventure cannot be held responsible if such information should prove inaccurate.
